Our price list is effective from 1st September 2008. We reserve the right to alter any price without prior notice. All prices are subject to VAT at the current applicable rate. The placing of an order with MWPI Ltd, ( Michael Webberley Photography and Imaging ) confirms acceptance of our Terms of Business, thus specifically excluding any Terms and Conditions proffered by the customer.

Quotations: These remain valid for 30 days from the date of issue and are invalid in the event of changes in the original job description.

Bookings: Studio and Location time will be charged as per the booked period unless the shoot time runs over the booked period, then an additional fee will apply. ie. If the booked period is one and a half days and the shoot only takes one day, a one and a half days fee will apply. If the booked period is one day and the shoot take one and a half days, then a fee for one and a half days will apply

Orders: Any order must be in the form of an e-mail or be accompanied by a written confirmation on the customer's letterhead and signed by an authorised official.

Reprints: By placing an order, the customer declares his right to reproduce all negatives and transparencies supplied to MWPI Ltd, ( Michael Webberley Photography and Imaging ). The customer assumes absolute liability for any resulting action by a third party.

Liability: Whilst every reasonable care is taken with customer's materials ( including originals ) the responsibility of MWPI Ltd, ( Michael Webberley Photography and Imaging ) for any loss or damage ( whether arising from loss of, or damage to, materials or from delay, or from any other cause whatsoever ) must be limited in the case of any one transaction to: (1) The materials cost of replacing any such items supplied by the customer ( such materials being accepted only on the understanding that their replacement cost does not exceed the current retail price of the material(s) used) . (2) Consequential loss and damage (if any) being subject to a maximum of £50. No liability is accepted by MWPI Ltd, ( Michael Webberley Photography and Imaging ) for the cost of reproducing original material and therefore, where material is deemed to be of high value, it is the customer's responsibility to notify us in writing and make their own insurance arrangements, prior to work being undertaken.

Claims: Mistakes will be rectified free of charge if notified immediately, and confirmed in writing within 3 days, providing the original work was accompanied by a written order, together with relevant material and instructions. Verbal instructions will only be accepted on the understanding that MWPI Ltd, ( Michael Webberley Photography and Imaging ) will not be held responsible for any mistake there from. Goods damaged in transit must be returned with their original packaging for inspection.

Despatch: Completed orders are despatched by, post, courier or other delivery service at our discretion. Orders collected and delivered by outside contractors are entirely at the customer's own risk.

Rush Charges: Rush charges may be levied on work required to meet tight deadlines, but only with the customer's prior agreement.

Original Photography and Computer Images Created by MWPI Ltd, ( Michael Webberley Photography and Imaging ): Where the terms of the order require MWPI Ltd, ( Michael Webberley Photography and Imaging ) to create original photography or computer Images, the copyright in such photography shall be the property of MWPI Ltd, ( Michael Webberley Photography and Imaging ) in accordance with the Copyright, Designs and Patents Act 1988. Any photographic reproduction shall be carried out only by MWPI Ltd, ( Michael Webberley Photography and Imaging ). Where MWPI Ltd, ( Michael Webberley Photography and Imaging ) have created original photographic or computer images, MWPI Ltd, ( Michael Webberley Photography and Imaging ) will once a licence, European or Worldwide has been granted allow the customer to reproduce the images in accordance with the original job description and the terms of the Licence for a period of two years, unless other wise stated. A European Licence excludes any use of imagery on the Internet, unless other wise stated. A Worldwide Licence includes use of imagery on the internet, unless otherwise stated. You may not remove any notice of copyright, MetaTag or other intellectual rights from any place where it is on or embedded in an image, re-sell, rent, lend, sub-license, assign, gift or otherwise transfer or distribute the image or the rights. Install and use any image in more than one location at a time or post a copy of the image on a network server or web server for use by other users. Use or display the image in a digital format that enables it to be downloaded or distributed via mobile or fixed devices or shared in any peer-to-peer or similar file sharing arrangement. Use the image as part of a trade-mark, design-mark, trade-name, business name, service mark, or logo; Incorporate the image in any product that results in a re-distribution or re-use of the image or is otherwise made available in a manner such that a person can extract or access or reproduce the image as an electronic file. You may not use the image for editorial purposes without including the following byline adjacent to the image: Michael Webberley / MWPI.

Payment: Payment by cash or cheque with order. Credit accounts may be opened upon receipt of two satisfactory trade references. Credit account facilities shall be at the absolute discretion of MWPI Ltd, ( Michael Webberley Photography and Imaging ). All accounts are payable in full within 30 days of date of invoice. 5% discount is offered on all invoices if paid within 14 days from invoice date. Overdue accounts incur a surcharge of 4% above LloydsTSB Bank Plc base rate.

Charges: Location charges between the hours of 0900 and 1700 hrs are calculated on an hourly rate up to two hours. After two hours a half day rate will apply. After four hours a full day rate will apply. When a location shoot starts or finishes outside the hours of 0900 to 1700 hrs then a higher hourly rate will apply for part of, or a whole hour, or hours. These charges also apply to any setting up time incurred before the start of a shoot, or time incurred after a shoot dismantling. Studio time is charged at a minimum of two hours. Any studio shoot longer than two hours, and up to four hours will be charged at a half day rate, and for over four hours and up to eight hours a full day rate will apply.

Cancellation of Photography: Cancellation of photography within 24 hours ( weekdays only ) will be charged at the fee for the booked period. Cancellation of photography within 48 hours ( weekdays only ) will be charged at 50% of the booked period. If photography has been booked for a Monday and is cancelled on the previous Friday, the cancellation charge will be within the 24 hours fee. Cancellation of photography while on location will be charged at the booked period plus any expences incured.

Lien and Retention of Titles: MWPI Ltd, ( Michael Webberley Photography and Imaging ) shall have a general lien on all of the customer's materials in its possession and shall reserve the right to retain any such materials until all monies due and payable have been received. In the event of non-payment in accordance with these terms and conditions for any original photography created by MWPI Ltd, ( Michael Webberley Photography and Imaging ), the licence to reproduce the image(s) if granted, shall be immediately revoked thereby rendering any reproduction of the image(s) by the customer a breach of copyright, for which MWPI Ltd, ( Michael Webberley Photography and Imaging ) reserves the right to take such legal action as may be appropriate.
